Tiny Champs Nursery Terms & Conditions

Registration Fee and Deposit: Prior to your child starting at the nursery, we will require a non- refundable registration fee and a deposit. The deposit will be refunded to you when your child leaves the nursery, provided one calendar month’s written notice is given and all nursery fees have been paid in full.

 In the event that a nursery place is not immediately available, then your child’s name will be placed on the waiting list. Children on the waiting list will be considered for nursery places in the order that they are registered, although priority will be given to siblings. The registration fee is payable for every child registered.

 Every attempt will be made to meet individual requirements. However, in order to ensure sufficient continuity of care, we recommend a minimum of two sessions attendance.

Please note: After the offer of a place and its acceptance. We will hold the place for 7 days prior to the deposit being paid. On the 8th day the space will become available to other children.

 Fees: Fees are payable by the parent(s)/carers individually and jointly (and by any third party who has agreed in writing to make, or assist with, payments). Fees are billed on a monthly basis and are calculated evenly over 52 weeks a year, by multiplying the weekly fee by 52 and dividing by 12. Fees for the first and last months of attendance (where these are not complete calendar months), and for any months where there is a change of sessions, are calculated according to the exact number of days/sessions attended in that month.

Fees are payable on the first business day of every month by standing order and/or the tax-free childcare scheme. The tax-free childcare scheme payment must reach us by the 25th of the previous month, so that they can be cleared by the payment due date.

Fees for the first month must be paid by the child’s second settling in session.

Fees are subject to changes from time to time. You will be given reasonable written notice of any such changes.

Termination or Cancellation: Should you wish to terminate your child’s placement at the nursery for any reason, one calendar month’s written notice is required. If you fail to give one month’s written notice, then one month’s fees will be payable in lieu of notice, and we will retain your deposit.

 On termination of this contract, we will refund to you the deposit, without interest, after confirming that all fees have been paid up to date. During the notice period, fees are still payable in full, whether your child attends the nursery or not.

If you cancel your child’s booking with the nursery during the calendar month prior to the agreed. start date, we will retain your deposit.

 Any postponements of the start date require one calendar month’s written notice, failing which fees will be charged from the original start date. If you postpone the start date by more than three months, we will retain your deposit, and you will have to register again and will be placed at the end of the waiting list.

Nursery Closure: The nursery is open all year round, with the exception of bank holidays, training afternoons (the dates for these will be confirmed to you at the beginning of each year) and the week between Christmas and New Year. Fees will be charged at the prevailing rates for such periods of closure and no refunds will be given for any weeks shortened by a bank holiday.

Temporary Interruptions in Service: In the event of a temporary interruption in service, where we require certain groups of children to stay at home and not attend the nursery, we will endeavor to offer home learning support. We will require a contribution to our costs whilst your child is absent at our request. This contribution will be for direct unavoidable costs that will not be reimbursed to us via other sources. The contribution will apply for a specified and modest period of time only. You may, if you wish, terminate your nursery contract during this time, without giving the required notice and without being charged any fees in lieu of notice.

Absences: You will not be entitled to any refund or release from liability for payment of fees by virtue of nonattendance of your child at the nursery for any reason, including sickness and holidays.

 Non-Payment of Fees: We reserve the right to exclude your child from the nursery upon failure by you to pay any fees or charges within seven days of the due date. In such circumstances, we also reserve the right to serve you with written notice to terminate and/or amend this contract with immediate effect. Arrangements will then be made to reclaim from you all fees in arrears, together with any late payment charges and associated costs and interest.

 Extra Sessions: Extra sessions may be booked by emailing the nursery. Extra sessions will be charged for at the usual daily rates and you will be charged for them on your next invoice.

Changes of Sessions: Attendance changes may be made by emailing the nursery. Changes will be accommodated, subject to availability. At least one months’ written notice is required for a reduction in sessions.

Late Collection: You are required to inform the nursery as early as possible if you are going to be late collecting your child, so that sufficient staff cover can be arranged. If a child is not collected before the official end of session time, we will make a late collection charge of £1 for every minute that you are late. Late collection charges will be added to your next invoice.

Additional Charges: A charge of £50 per week will be made for any fees that are paid late.

Disclosures: We need to be informed about any non-medical condition, health problem, allergy or suspected learning difficulty affecting your child. We also need to be informed of any family circumstances or court orders that may affect your child whilst in our care. Please ensure that such information is disclosed on your child’s personal record.

 In addition, you are required to inform the nursery in writing of any changes to the information held by us (e.g., changes to emergency contacts, dietary requirements, allergies, etc.).

Confidentiality: Children are never discussed with any parent other than their own, and confidentiality is maintained at all times. However, it is a condition of your child’s attendance that we may disclose, on a need to know basis, within or outside the nursery, any confidential information or circumstances that may have a bearing on your child’s health, safety and welfare.

Privacy Statement and Data Protection: We are a Data Controller for the purposes of the Data Protection Act 1998. We will collect information about your child and use this personal data to support your child’s development, monitor and report on your child’s progress and assess how well the nursery is doing as a whole. We will at all times have due regard for the DPA and GDPR. We are required by law to pass some information to the Local Authority and the Department of Education through the annual Early Years Census. This information includes your child’s name, date of birth, home address, the number of free entitlement hours you are accessing for your child and personal characteristics, such as ethnic group and whether your child has special educational needs. If you wish to see a copy of the information that we hold, then please speak to the nursery manager.

Illness: We may require you to withdraw your child from the nursery in the event that he/she requires special medical care or attention, which is not available, or which is refused by you, or it is considered that your child is not well enough to attend.

You may also be required to withdraw your child if we have reasonable cause to believe that the child is, or may be, suffering from any contagious disease, and there remains a danger that other children or staff at the nursery may contract such a disease. Please read the literature provided regarding incubation and exclusion periods.

 We have a realistic attitude to the needs of working parents but reserve the right to contact you if your child becomes ill during nursery hours.

 You are requested to inform the nursery if your child contracts any normal childhood ailments or illnesses.

 Removal: We may require you to permanently withdraw your child from the nursery in the event that we consider it to be necessary in the best interests of your child and/or the nursery. We will consult with you before making such a decision, but this could arise, for example, on the grounds of a child’s disruptive or inappropriate behaviour, or medical condition.

Please note: we would only remove a child’s space in extreme circumstances.

Security: Under no circumstances will a child be allowed to leave the nursery with anyone unknown to the staff, unless previously arranged by you. If you make prior arrangements by telephone, the nursery will require the name, address and telephone number of the chosen person, as well as proof of identity on their arrival. A password will also be required.

Abuse to Staff Zero Tolerance: We will not tolerate any verbal or physical abuse, harassment, intimidation or violence towards any of the nursery staff, parents or visitors at any time. Anyone exhibiting inappropriate behaviour will be required to permanently leave the nursery premises and not return. This may result in the immediate loss of your child’s nursery place. More serious episodes will be reported to the police.

Concerns/Complaints: The manager must be informed immediately, and in writing, of any concern or complaint in respect of the care of your child, that has not been resolved informally to your satisfaction.

Liability: We accept no liability for any pecuniary or other loss suffered by you arising directly or indirectly as a result of the nursery being temporarily closed or the non-admittance of a child to the nursery for any reason.

 Property and Belongings: We cannot be held responsible for loss or damage to children’s property, including pushchairs and car seats left on our premises (unless this is due to the negligence of our staff). Every reasonable effort will be made by the staff to ensure the children’s belongings are not lost or damaged. Practical ‘inexpensive’ clothing, labelled with your child’s full name, is strongly recommended.

Insurance: We maintain those insurances that are required by law. Copies of the current Employer’s Liability and Public Liability insurance policies are displayed in the reception area of the nursery.

Nursery Staff: Nursery staff are permitted to babysit out of hours. This is a private agreement between yourself and the staff member and is not affiliated with the nursery.

If a member of staff leaves our employment and is subsequently employed by you as a nanny, childminder, babysitter, teacher, governess, etc. within six months of their leave date, you will be charged a recruitment fee of £2,000, which will be due for payment immediately on request.

 Managing Change: Every nursery must initiate and respond to change. Many aspects of the nursery may change during your child’s period of attendance, and we reserve the right to make lawful and reasonable changes to the curriculum, education framework, routines, activities, premises, facilities, calendar, timetable and policies and procedures.

Safeguarding Children: It is understood that the nursery is under obligation to report to the relevant authorities any incident where we consider a child may have been abused or neglected. This may be done without informing the parent/carer.

 Any information given by a parent/carer regarding their child will be treated with the utmost confidentiality, except in cases where abuse towards a child is suspected.

Photographs: You should be aware that the nursery will take photographs, which may be used in training or promotional material. Permission will be sought during registration and parental wishes in regards to this will always be adhered to.
